§ 1. Definitions
Terms used in these Terms mean:
- Platform
- the DailyHair website available at dailyhair.pl together with the app, through which Tickets are sold.
- Operator
- Do More Soft Hubert Ptaszek, ul. Olszewskiego 6, 25-663 Kielce, Poland, VAT ID 7681848372, operating the Platform and acting as intermediary in Ticket sales.
- Organizer
- the entity organizing the Event, on whose behalf and for whose benefit the Operator sells Tickets. The Organizer is the seller of the Ticket and party to the participation agreement.
- Event
- a show, workshop, training course or other hairdressing and beauty industry event for which a Ticket is sold, described on the Event page on the Platform.
- Ticket
- an electronic entitlement to take part in an Event (e-ticket) with an individual code and QR code, scanned once at entry.
- Account
- the set of resources and settings assigned to the Buyer on the Platform, available after signing in, holding among other things orders and Tickets.
- Buyer
- a natural person, legal person or organizational unit placing an order for a Ticket through the Platform.
- Consumer
- a Buyer who is a natural person making a purchase not directly related to their business or professional activity, as well as a natural person concluding a contract directly related to their business activity where the purchase is not of a professional character for them (Art. 38a of the Consumer Rights Act).
§ 2. General provisions
These Terms set out the rules for using the Platform and concluding Ticket sales contracts for Events through it. They constitute terms for the provision of services by electronic means within the meaning of the Act of 18 July 2002 on the provision of services by electronic means.
Acceptance of the Terms is voluntary but necessary to place an order. By placing an order, the Buyer confirms that they have read the Terms and accept their provisions.
The Terms are made available on the Platform free of charge, in a way that allows them to be obtained, reproduced and stored at any time.
§ 3. DailyHair's role (disclosed agent)
The Operator acts as the Organizer's disclosed agent. Ticket sales are conducted on behalf of and for the benefit of the Organizer, who remains the seller of the Ticket and party to the participation agreement concluded with the Buyer.
The Organizer alone is responsible for the organization, course, content and quality of the Event, as well as for its cancellation or rescheduling. The Operator is responsible for the correct operation of the Platform, payment processing and e-Ticket delivery.
The Operator collects the full gross Ticket price from the Buyer, deducts its commission fee (plus VAT) and passes the remainder to the Organizer. VAT on the Ticket price is settled by the Organizer.
The Organizer's identity is always shown on the Event page. In case of doubt as to who is party to the participation agreement, the information given on the Event page at the time of purchase prevails.
§ 4. Technical requirements
Using the Platform requires: a device with internet access, an up-to-date web browser with JavaScript and cookies enabled, a working e-mail address and — to present the Ticket — a device able to display a QR code or the ability to print it.
The Operator strives to keep the Platform available continuously, but reserves the right to brief technical breaks needed for maintenance, updates or fault repair. Where possible, the Operator gives advance notice of planned breaks that may materially affect purchasing.
§ 5. User account
Buying a Ticket is possible after creating an Account or — where the Platform allows it — without registration, by providing the data needed to process the order. Creating an Account is free of charge and voluntary.
The Buyer must provide accurate data and protect their credentials against unauthorized access. The Buyer does not share the Account with third parties and promptly notifies the Operator of any suspected unauthorized access.
The Buyer may delete the Account at any time. Deleting the Account does not affect the validity of Tickets purchased earlier or obligations arising from law (e.g. retention of accounting records).
§ 6. Placing an order and concluding the contract
An order is placed by selecting the Event and Ticket type, indicating the number of Tickets and providing the data needed to process the order and issue the e-Ticket (participant's name, e-mail address, optionally phone number).
After Tickets are selected, places are reserved for the time needed to complete payment. Failure to pay within the set time causes the reservation to expire and the places to be released. The contract is deemed concluded once payment is booked and the Ticket is issued.
The Buyer confirms an order with an obligation to pay using a button that clearly indicates that obligation. Immediately before placing the order, the Buyer sees a summary: the Event, the Ticket type and quantity, the total price and the Organizer acting as seller.
§ 7. Prices and payments
Ticket prices shown on the Platform are gross prices stated in Polish zloty (PLN) and include all public charges. The binding price is the one shown in the order summary immediately before payment.
Payments are handled by Stripe Payments Europe. Available methods are BLIK, payment card and Przelewy24. The list of methods may vary by Event and is shown on the payment page.
The Operator does not store the Buyer's payment instrument data — it is processed directly by the payment provider in an environment compliant with the PCI DSS standard. Order processing begins once payment confirmation is received. If no confirmation arrives within a reasonable time, the order is not concluded and any funds collected are refunded.
§ 8. Ticket delivery
Once payment is booked, the Ticket in electronic form (e-ticket with QR code) is sent to the e-mail address given in the order and made available in the My tickets panel. A printable PDF version is attached to the message.
The QR code grants a single entry and is scanned at the Event entrance. After the first successful scan the Ticket loses validity — reuse of the same code is not possible.
If the message with the Ticket does not arrive within a few minutes of payment, please check your spam folder and sign in to the My tickets panel. In case of problems, contact: pomoc@dailyhair.pl.
§ 9. Buyer obligations and ticket use
The Ticket is intended for personal use. Reselling the Ticket for profit and its commercial use are prohibited without the Organizer's consent, as is sharing the QR code with third parties in a way that enables multiple entries.
The Organizer or Event staff may refuse entry to a person using a Ticket that is invalid, already used, forged or obtained in breach of these Terms. The venue rules and the Organizer's order instructions apply at the Event.
The Buyer uses the Platform in accordance with the law and good practice; supplying unlawful content and any actions disrupting the Platform's operation or breaching its security are prohibited.
§ 10. Right of withdrawal
Under Art. 38(12) of the Act of 30 May 2014 on Consumer Rights, the 14-day right of withdrawal does not apply to contracts for services connected with leisure, sporting or cultural events where the contract specifies a day or period of performance. A Ticket to an Event with a set date is such a service.
This does not exclude the Buyer's rights in the event of cancellation or material change of the Event (§ 11), or claims arising from non-conformity of the service with the contract.
§ 11. Cancellation or change of event. Refunds
If the Organizer cancels the Event, the Buyer is entitled to a refund of the full price paid for the Ticket. The refund is made to the account or payment instrument used for payment, without undue delay and no later than 14 days from the date of learning of the cancellation.
In the event of a material change to the Event (in particular a change of date or venue), the Buyer may keep the Ticket on the new terms or request a refund on the same basis as for cancellation.
Because the Operator collects the full Ticket price from the Buyer, the refund is made by the Operator on behalf of and for the benefit of the Organizer — the Buyer does not need to contact the Organizer separately for this. The Operator coordinates and carries out the refund through the same channel used for payment.
Returning a Ticket for reasons attributable to the Buyer (withdrawing from participation) is possible only where the Organizer has allowed this in the Event description, on the terms set out there.
§ 12. Complaints
Complaints regarding the operation of the Platform, the purchase process, payment or Ticket delivery may be submitted to pomoc@dailyhair.pl. A complaint should include the order number, a description of the problem and contact details.
We review complaints within 14 days of receipt, informing the Buyer of the outcome at the e-mail address provided. Failure to respond within that period means the Consumer's complaint is upheld.
Complaints regarding the course, content or quality of the Event are reviewed by the Organizer. The Operator forwards such reports to the Organizer and supports the Buyer in making contact.
§ 13. Invoices
An invoice is issued for the Ticket in accordance with applicable law. The Operator issues an invoice for the intermediation commission; the Organizer issues an invoice for participation in the Event — to the extent this obligation rests on the Ticket seller. The VAT rate and any exemption depend on the nature of the Event (e.g. vocational training may be exempt under Art. 43(1)(29) of the VAT Act).
A request for an invoice with buyer details and the invoice data should be indicated by the Buyer at the latest while placing the order. Invoices are issued and delivered electronically, to which the Buyer consents.
§ 14. Liability and force majeure
The Operator is liable for the proper provision of Platform services on general terms. Towards a Buyer who is not a Consumer, the Operator's liability for lost profits is excluded, and total liability is limited to the Ticket price — within the limits permitted by law. These limitations do not apply to Consumers or to damage caused intentionally.
Neither party is liable for non-performance or improper performance caused by force majeure — an external, extraordinary event impossible to prevent (including natural disasters, infrastructure failures, decisions of authorities, epidemics). The effects of cancelling an Event due to force majeure are settled in accordance with § 11.
§ 15. Intellectual property
The Platform and its elements (software, layout, trademarks, the DailyHair logo, graphics and texts) are legally protected and owned by the Operator or entities from which the Operator has obtained the relevant rights. Using them beyond the scope of permitted use requires the rightsholder's consent.
Materials concerning Events (descriptions, photographs, Organizers' marks) are provided by the Organizers, who declare that they hold the rights to publish them. Obtaining a Ticket does not transfer rights to these materials to the Buyer.
§ 16. Personal data
The rules for processing the personal data of the Buyer and Event participants are described in the Privacy Policy.
§ 17. Out-of-court dispute resolution
A Consumer has the right to use out-of-court methods of handling complaints and pursuing claims, including permanent consumer arbitration courts and mediation at the regional Trade Inspectorate offices. Detailed information is available at the offices and websites of district (municipal) consumer ombudsmen and the Office of Competition and Consumer Protection.
A Consumer may also use the EU online dispute resolution (ODR) platform available at ec.europa.eu/consumers/odr. Use of out-of-court procedures is voluntary and requires the consent of both parties.
§ 18. Final provisions
Matters not governed by these Terms are subject to Polish law, in particular the Civil Code and the Consumer Rights Act. The Operator may amend the Terms for valid reasons; orders placed before a change are subject to the Terms in force at the time the order was placed.
If any provision of the Terms proves invalid or ineffective, the remaining provisions remain in force. Provisions less favorable to the Consumer than mandatory law do not bind the Consumer — those provisions of law apply instead.
